How to support someone with mental wellness issues who is not competent to make decisions?

If an individual is willing to accept aid, they can call the Social Security office and allow you to be their  payee to help with financial matters. They can agree to sign a document assigning you as the role of Power of Attorney for some or all of the following categories: medical, financial, residential decisions and property.  There are free documents on line that will need to be signed in front of a notary: On Line Power of Attorney Templates , Nebraska Power Attorney of Healthcare Form.  Nebraska has an Advanced Mental Health Directive  that must comply with Nebraska Statutes check out the link: Nebraska Mental Health Directive FAQ. A lawyer can be consulted to complete legal documents.

In a crisis, a temporary guardianship can be filed to allow an advocate to make decisions on healthcare and financial matters. This must be filed with the courts.  An attorney with expertise in guardianship needs to be consulted.

Long-term guardianship will need to go through the county courts.  An attorney with experience in guardianship needs to be consulted.  The attorney will guide the advocate through the process. The person seeking guardianship will need to pay attorney fees, court fees, provide a background and credit check, and complete a guardianship course.

To learn more about supported decision making, Power of Attorney, and guardianship, check out this PowerPoint, Guardianship, Alternatives and the Office of Public Guardian, provided by the Nebraska Office of Public Guardian. 402.471.2862

How to apply for Social Security Benefits?

If unable to work full-time due to mental health issues, an individual can apply for social security benefits.  Proof of diagnosis and the onset of disability date will need to be provided when applying.  The Individual will need to state the reasons they are unable to work.  It is important to gather documentation regarding disability before applying. One may work with the Social Security Office to apply. This is a complex process, and often people are denied the first application.

Working with someone with expertise in this area can be very beneficial.  One can hire an attorney who specializes in applying for Social Security benefits.  Centerpointe offers support and aid in applying for Social Security Benefits with their SOAR(SSI/SSDI Outreach Access and Recovery) program.

What supports are available for the various levels of need for mental wellness?

Secure Residential Programs are locked facilities that support those who are a danger to themselves or others.  This program will need a referral from a mental health provider.  This includes the Regional Center of Nebraska. The goal is to treat them so they can move to a lower level of care within the community.

Residential Programs are designed for those who are not a danger to themselves or others but need a high level of support to cope with symptoms of their illness and regain skills in coping and self-care. A referral is needed by a mental health agency or provider.

Assisted Living Residential Programs for individuals whose symptoms are stable but still need support in medication management, maintaining health appointments, and providing meals. Referral needs to be completed.
